By accessing or using EscapeWish ("the Service"), operated at escapewish.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
EscapeWish is a collaborative travel planning platform that allows users to create, organize, research, and plan travel destinations with other users in shared "parties." The Service includes AI-powered research, trip itineraries, budget tracking, deal monitoring, and achievement systems.
You must sign in with a valid Google account to use EscapeWish. You are responsible for maintaining the security of your Google account and for all activities that occur under your account. You must not share your account access with others or create multiple accounts.
You agree not to: use the Service for any unlawful purpose; submit content that is abusive, harassing, defamatory, obscene, or otherwise objectionable; attempt to gain unauthorized access to the Service or its systems; interfere with or disrupt the Service; use automated tools, bots, or scrapers to access the Service; or impersonate any person or entity.
You retain ownership of the content you create on EscapeWish (destinations, notes, comments, suggestions, budget entries). By posting content, you grant EscapeWish a non-exclusive, worldwide, royalty-free license to use, display, and store your content as necessary to operate the Service. Content you share within a party is visible to all party members.
EscapeWish uses artificial intelligence (Anthropic's Claude) to generate destination research, trip itineraries, price estimates, and other travel information. This content is provided for informational and planning purposes only. AI-generated content may contain inaccuracies, outdated information, or errors. We do not guarantee the accuracy, completeness, or reliability of AI-generated content. You should independently verify all travel information, prices, visa requirements, safety conditions, and other details before making travel decisions or purchases.
Flight costs, hotel prices, and price watch estimates are AI-generated approximations and do not reflect real-time pricing from any booking platform. EscapeWish does not sell travel services, flights, accommodations, or any travel products. Price estimates should not be relied upon for booking decisions. Actual prices may vary significantly.
The Service integrates with third-party services (Google, Anthropic, Unsplash, BigDataCloud) and may contain links to third-party websites. We are not responsible for the content, privacy practices, or availability of third-party services. Your use of third-party services is subject to their respective terms and privacy policies.
The EscapeWish name, logo, design, and codebase are the property of EscapeWish and its creators. Cover images are provided by Unsplash and are subject to the Unsplash License. You may not copy, modify, distribute, or reverse engineer the Service without our express written consent.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE DISCLAIM ALL WARRANTIES INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. YOUR USE OF THE SERVICE IS AT YOUR OWN RISK.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ESCAPEWISH AND ITS CREATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR LOSSES ARISING FROM TRAVEL DECISIONS MADE BASED ON INFORMATION PROVIDED BY THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO USE THE SERVICE (CURRENTLY $0 FOR FREE ACCOUNTS).
You agree to indemnify and hold harmless EscapeWish and its creators from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
EscapeWish is currently in Alpha and is provided free of charge. We reserve the right to modify, suspend, or discontinue the Service at any time without notice. We may terminate or suspend your account at our discretion if you violate these Terms.
These Terms are governed by and construed in accordance with the laws of the State of Tennessee, United States, without regard to conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of Hamilton County, Tennessee.
We may update these Terms at any time. We will notify users of material changes by updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance.
